Terms And Conditions Dubsado Audit Service

1. Scope of Service

1. The Dubsado Audit is a specialized digital analysis and consulting service designed to review, evaluate, and provide actionable recommendations for your existing Dubsado account and client workflows.

2. The deliverable includes a written audit report/checklist, a recorded walkthrough or live strategy session (depending on your selected package), and actionable setup recommendations.

3. The Dubsado Audit is an advisory and evaluative service. Unless explicitly purchased as a separate "Done-For-You" implementation package, implementation of the audit recommendations remains the sole responsibility of the Client.

2. Client Responsibilities & Intake Deadline

1. Intake Deadline: To maintain your scheduled audit slot, you agree to grant user access to your Dubsado account and submit your completed intake questionnaire within 7 calendar days of completing your purchase.

2. Scheduling & Delays: Audit review slots are allocated only after both account access and intake materials are received. If you fail to provide materials within 7 calendar days, your audit review will be moved to our next available opening.

3. Inactive Projects & Forfeiture: If you fail to provide account access or intake responses within 30 calendar days of purchase, the project will be marked inactive and all service fees will be forfeited without refund. Reactivation after 30 calendar days is subject to availability and a £75 administrative reactivation fee.

3. Payment Terms & Billing

1. Payment for the Dubsado Audit is due in full at the time of purchase via our authorized payment processor (ThriveCart / Stripe / PayPal).

2. All prices are listed in GBP (£) unless otherwise stated.

4. Cancellation, Refunds & Statutory Cooling-Off Waiver

4.1 Business-to-Business (B2B) Sales

If you purchase this service for business or commercial purposes:

• All sales are final. Once payment is completed, no refunds (full or partial) will be issued.

4.2 Consumer Sales & Statutory Cooling-Off Waiver

If you purchase this service as an individual consumer under UK Consumer Contracts Regulations:

• Statutory Right to Cancel: You have a statutory right to cancel your purchase within 14 calendar days, provided we have not commenced work on your audit.

• Waiver of Cooling-Off Period: By submitting your intake questionnaire or granting us access to your Dubsado account prior to the end of the 14-day cancellation window, you explicitly request and authorize us to begin the service immediately. You acknowledge and agree that once intake materials or account access are provided, you explicitly waive your 14-day statutory right to cancel, and no refunds will be issued.

• Pre-Work Cancellations: If you request a cancellation within 14 calendar days of purchase and prior to providing intake details or account access, a full refund will be issued back to your original payment method.

5. Rescheduling & Live Sessions

If your Dubsado Audit package includes a 1:1 live Zoom or strategy call:

1. You may reschedule your scheduled call up to 24 hours prior to the call time using the booking link provided.

2. If you fail to attend a scheduled call without providing 24 hours' prior notice (No-Show), the live call portion of your audit will be forfeited. Your written audit report and recorded walkthrough will still be delivered as planned.

6. Intellectual Property & Confidentiality

1. Proprietary Materials: All templates, custom workflow framework documents, guides, and reports provided by The Freedom Creative remain our intellectual property. You are granted a non-exclusive, non-transferable license to use these materials solely for your internal business operations.

2. Confidentiality: We respect your privacy and business operations. Any proprietary client data, lead information, or internal processes accessed inside your Dubsado account during the audit will be kept strictly confidential and will not be shared with third parties.

7. Limitation of Liability & Warranties

1. Third-Party Software Disclaimer: The Freedom Creative is an independent service provider and Dubsado Specialist. We are not employed by, affiliated with, or responsible for the performance, uptime, security, software bugs, or policy changes of Dubsado (Dubsado, Inc.).

2. No Guaranteed Outcomes: While the audit provides expert analysis based on industry best practices, we make no guarantees regarding specific financial gains, conversion rates, or sales performance resulting from implementing our recommendations.

3. Maximum Liability: To the fullest extent permitted by law, our total financial liability for any claim arising out of this agreement shall not exceed the total amount paid by the Client for the Dubsado Audit service.

8. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
